Site content (text, graphics, logos, icons, images, software, and original editorial material) is owned by Flappy Bird Pro or its licensors and protected by intellectual property laws.

Games, characters, trademarks, and related assets embedded or linked from third parties remain the property of their respective rights holders. Flappy Bird Pro is an independent fan / aggregator site and is not affiliated with, endorsed by, or sponsored by the original Flappy Bird rights holders or other game publishers unless expressly stated.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use. This license does not include rights to reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit Site content, or to use data-mining tools on the Site.

All rights not expressly granted are reserved.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAPPY BIRD PRO, ITS OPERATOR, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

Because much of the Site is free, our total maximum liability for claims under these Terms shall not exceed EUR 100 (or local equivalent), or the amount you paid us in the 12 months before the claim (if higher), whichever applies.

These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or liability that cannot be limited under applicable law (including mandatory EU consumer rights).

14. Indemnification

You agree to defend, indemnify, and hold harmless Flappy Bird Pro and its operator from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, your violation of law or third-party rights, or content you submit — except where prohibited for EU consumers by mandatory consumer protection law.

15. Termination and Suspension

16. Dispute Resolution

Contact us first at contact@flappybirdpro.com with a detailed written notice. We will respond within 30 days and try to resolve disputes informally.

16.1 EEA and UK Users

If informal resolution fails within 30 days, you may bring a claim in the courts of your country of habitual residence. Nothing limits your rights as an EU consumer under mandatory local law.

16.2 US Users

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS.

If you are in the United States and informal resolution fails, you and Flappy Bird Pro agree to resolve disputes through binding individual arbitration under recognized rules (e.g. AAA or JAMS), rather than in court. YOU AND FLAPPY BIRD PRO WAIVE JURY TRIAL AND CLASS ACTION PARTICIPATION.

Excluded from arbitration: claims for injunctive relief to protect intellectual property, and claims within small-claims court jurisdiction. Class arbitrations and class actions are not permitted.

17. Governing Law

17.1 EEA and UK Users

These Terms are construed under applicable EU law and the laws of your country of habitual residence, without prejudice to mandatory consumer protections more favorable to you.

17.2 US Users

These Terms are governed by applicable US state law without regard to conflict-of-law rules. Disputes not subject to arbitration shall be resolved in competent state or federal courts, and you consent to jurisdiction there.

18. Copyright Infringement (DMCA)

If you believe content on the Site infringes your copyright, follow the process in our DMCA page, or email contact@flappybirdpro.com with a complete DMCA notice.

19. Filtering and Parental Controls

Parental control tools may help restrict content that is harmful to minors. A comparison is available at Wikipedia — content-control software. Flappy Bird Pro does not endorse any specific product listed there.

20. Miscellaneous

These Terms and the Privacy Policy are the entire agreement regarding use of the Site and supersede prior agreements.

• If any provision is unenforceable, the remainder stays in effect
• Failure to enforce a provision is not a waiver
• You may not assign rights without our consent; we may assign ours
• We are not liable for failures due to causes beyond reasonable control
• These Terms create no partnership, employment, or agency relationship
